he arta360 platform (https://arta360.com) is operated by Convex Technologies S.R.L., a Romanian legal entity, headquartered at Str. Edgar Quinet, nr. 29, Cluj-Napoca, Romania, registered with the Romanian Trade Registry under no. J12/756/20.02.2023, tax ID RO47666502 ("arta360", "we", "us").
These Terms and Conditions ("Terms") govern the use of the arta360 platform by people who browse, order, and purchase original artworks ("Buyer", "you"). For the terms applicable to artists who list and sell artworks on the platform, see the Artist Terms and Conditions.
By creating an account or placing an order on arta360, you confirm that you have read, understood, and accepted these Terms.
1. What the platform is
arta360 is an online marketplace connecting independent artists with people interested in purchasing original artworks. arta360 is not the seller of any artwork listed on the platform — the sale contract is formed directly between you and the artist who lists the artwork. arta360's role is to provide the technical infrastructure (catalogue, cart, payment, messaging, logistics) and to process payment on the artist's behalf, retaining a per-order commission.
2. Eligibility and account
2.1. You must be at least 18 years old and have full legal capacity to place an order.
2.2. You are responsible for the accuracy of the information you provide at registration (name, shipping address, billing details) and for keeping your account password confidential. Notify us immediately if you suspect unauthorized access to your account.
2.3. You may browse the catalogue and use the wall-preview / AI recommendation features without an account; creating an account is required to place an order.
3. Orders and contract formation
3.1. Adding an artwork to your cart does not constitute a binding order. The order is placed at the moment payment is confirmed at the end of checkout.
3.2. arta360 makes commercially reasonable efforts to accurately display artwork images and colors; actual colors may vary slightly depending on your monitor or screen calibration. This does not constitute a non-conformity of the product.
3.3. Each artwork is typically a unique piece or part of a limited edition. For this reason, we reserve the right to cancel an order (with a full refund) if the artwork is no longer available for reasons beyond our control (for example, a stock error or the artist withdrawing the piece before shipment).
4. Prices, taxes, and payment
4.1. Displayed prices are in RON and do not include shipping costs or any applicable taxes, which are shown separately before you complete your order.
4.2. Payment is processed through authorized third-party payment processors (Stripe). arta360 does not itself store your full card details — these are handled directly by the payment processor, in compliance with the PCI-DSS standard.
4.3. The payment collected is routed to the selling artist, minus the per-order commission retained by arta360, per the commercial agreement between arta360 and the artist.
5. Shipping
5.1. The artist is responsible for shipping your order within the timeframe communicated at the time of purchase (typically within 7 calendar days of order confirmation, per the artist's commitment to arta360).
5.2. Delivery is carried out by partner couriers or the method indicated at checkout. Risk of loss or damage to the item passes to you (or a third party you designate, other than the carrier) upon physical receipt of the parcel.
6. Right of withdrawal and returns
6.1. As a consumer, you are entitled to withdraw from the distance contract within 14 calendar days of receiving the goods, without needing to justify your decision, under Romanian Government Emergency Ordinance no. 34/2014 (transposing EU Directive 2011/83/EU on consumer rights).
6.2. The return procedure, condition requirements for the returned item, refund timelines, and applicable exceptions (for example, for made-to-order/personalized pieces, where applicable) are detailed in the Return Policy, which forms an integral part of these Terms.
6.3. Refunds are issued using the same payment method used for the purchase, within the legal timeframe, after we receive and verify the conformity of the returned item.
7. Intellectual property
7.1. Photographs, descriptions, and content for each artwork belong to the artist or are licensed by the artist to arta360 for display on the platform.
7.2. The platform's structure, interface, graphic elements, logo, and source code belong to arta360/Convex Technologies S.R.L. and are protected under applicable copyright and intellectual-property law. Reproducing or systematically extracting platform content without our prior written consent is prohibited.
8. Prohibited conduct
You may not use the platform to: infringe third parties' intellectual-property rights, publish illegal, threatening, discriminatory content or content exploiting minors, harass other users, or attempt to circumvent the platform's payment/commission mechanisms (for example, by arranging a direct transaction with an artist, outside the platform, for an artwork listed on arta360).
9. Limitation of liability
9.1. arta360 acts as a technical intermediary between you and the artist and is not responsible for the artistic quality, subjective authenticity, or market value of the artworks — except for the originality guarantee each artist commits to (see the Artist Terms).
9.2. arta360 is not liable for indirect damages, loss of profit, or data loss resulting from use of the platform, to the extent permitted by applicable Romanian law, which does not permit limiting liability for willful misconduct, personal injury, or other harms for which the law expressly prohibits limitation.
9.3. Nothing in these Terms limits your mandatory statutory rights as a consumer, which prevail over any conflicting provision.
10. Personal data protection
We process your personal data (name, shipping and billing address, order history, platform usage data) in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Romanian law. Full details on the purposes of processing, legal bases, data recipients (including third-party processors — Stripe for payments, our courier partner, our hosting provider, and the AI service provider used for the wall-preview feature), retention periods, and your rights (access, rectification, erasure, portability, objection, withdrawal of consent) are available in our Privacy Policy.

11. Dispute resolution
11.1. If you have a complaint, please contact us first at the address below so we can try to resolve it amicably.
11.2. You may file a complaint with the Romanian National Authority for Consumer Protection (ANPC) — https://anpc.ro — or use the EU Online Dispute Resolution (ODR) platform — https://ec.europa.eu/consumers/odr.
11.3. Any dispute that cannot be resolved amicably falls under the jurisdiction of the competent Romanian courts, without prejudice to your right, as a consumer, to bring proceedings before the courts of your place of residence.
12. Changes to these Terms
We may update these Terms from time to time, typically to reflect legal, functional, or commercial changes. We will notify you of any material change with reasonable advance notice before it takes effect; placing an order after a new version takes effect requires you to re-confirm your acceptance through the platform. The version you accepted and the date of acceptance are recorded on your account.
13. Governing law and language
These Terms are governed by Romanian law, without prejudice to any mandatory consumer-protection provisions applicable in your country of residence if you are a consumer from another EU member state. This English version is provided for convenience; the Romanian version is the legally authoritative text in case of any discrepancy.
